Acceptance of the Terms and Conditions
All website services provided to you by Silvera for Seniors, and any of its respective communities, affiliated and unaffiliated partners (together herein referred to as “Silvera” or “we”) are provided to you subject to the following terms and conditions of service.
By using or accessing (either by computer, e-reader, mobile or other electronic device now or hereafter devised) any Silvera website, mobile enabled website, or mobile application (each a “Silvera Site” and collectively, the “Silvera Sites”) or any content or other services available on a Silvera Site (each a “Service” and collectively, the “Services”) you agree to be bound by these terms and conditions and such other additional or alternative terms, conditions, rules and policies which are displayed or to which you may be directed in connection with any particular Silvera Site or Service (collectively the “Terms and Conditions”), all as may be modified by Silvera in accordance with these Terms and Conditions. Without limiting the generality of the foregoing, the Terms and Conditions will also apply if you access a Silvera Site or Service, or authenticate as a user, through a third party website or social media application (for example, through Twitter® or Facebook®). If you do not agree with these Terms and Conditions, do not use any Silvera Site or any of the Services.
User Conduct including social media sites
All information, data, text, software, music (including both the particular performance(s) and the underlying musical composition) sound, photographs, graphics, images, avatars, video, messages, ideas, reviews, opinions, suggestions or other materials on a Silvera Site, including links to any third party websites or social media applications embedded therein (“Content”), uploaded, posted or otherwise submitted by a user to a Silvera Site or the Services (“User Content”) is the sole responsibility of the person from which such User Content originates and any uploading, posting or other submission of such User Content is subject to the restrictions as outlined below.
Your Registration Obligations
You may be required to establish an account or otherwise register (each a “Member Account”) to participate in certain Services on the Silvera Site. When you provide registration information, you agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the applicable Services’ registration form (such information collectively being the “Registration Data”); and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, we have the right to suspend or terminate your Member Account. During registration, you may be asked to provide an e-mail address and to create your own password. Your e-mail address will become your user identification (“User ID”).You are responsible for maintaining the confidentiality of the password and your Member Account, and are fully responsible for all activities that occur under your password or Member Account. You agree to: (a) immediately notify Silvera of any unauthorized use of your password or Member Account or any other breach of security; and (b) ensure that you exit from your Member Account at the end of each session. Silvera cannot and will not be liable for any loss or damage arising from your failure to comply.
You acknowledge and agree that where you are required to set up a Member Account (for example, to have access to certain documents, if you choose to do so using personal information provided by a third party website or application such as Facebook® or Twitter®, this paragraph constitutes prior written notice to you of, and your consent to, the collection and use of your personal information by Silvera for the purposes of setting up the Member Account.
Restrictions on Use of Materials
You shall at no time assert any claims of ownership over any content by reason of your use of or any right to use this Site and shall not grant or create or suffer to exist any lien or other security interest arising therefrom. You agree to comply with all copyright and trademark laws and you shall not encumber any interest in, or assert any rights to, the Content. You may not modify, transmit, participate in the sale or transfer of, or create derivative works based on any Content, in whole or in part. You may print copies of the Content, provided that these copies are made only for personal, non-commercial use and that you maintain any notices contained in the Content, or maintained by the Contributor, such as all copyright notices, trademark legends, or other proprietary rights notices. You shall not store electronically any significant portion of any Content. Silvera authorizes you to view and use the Content on this Site solely for your personal, noncommercial use. The use of the Content on any other site, including by linking or framing, or in any networked computer environment for any purpose is prohibited without the prior written approval.

The content provided on this website is provided as a service to members of the public. Information presented on this website is provided for informational purposes only. User Must Comply with Applicable Laws
This Site is based in Calgary, Alberta. Silvera makes no claims concerning whether the Content may be downloaded or are valid for use outside Alberta. If you access this Site from outside Alberta, you are solely responsible for ensuring compliance with the laws of your specific jurisdiction.
In the event that any portion of the Agreement is held to be invalid or unenforceable, the invalid or unenforceable portion shall be construed in accordance with the applicable law as nearly as possible to reflect the original intentions of the parties, and the remainder of the Agreement shall remain in full force and effect. The paragraph headings herein are provided only for reference and shall have no effect on the construction or interpretation of the Agreement. Silvera’s failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of its right to subsequently enforce such provision or any other provision of this Agreement. Neither the course of conduct between parties nor trade practice shall act to modify any provision of the Agreement. The Agreement shall be governed by and construed in accordance with the laws of Alberta and Canada. Any action relating to the Content, Site or this Agreement must be brought in the provincial and federal courts, and you hereby irrevocably consent to the jurisdiction of such courts. Any cause of action you may have with respect to the Content, Site or this Agreement must be commenced within one (1) year after the claim or cause of action arose, or be barred. This Agreement contains the entire agreement of the parties for this Site and supersedes all existing agreements and all other oral, written or other communication between the parties concerning its subject matter. You agree to use the Content and Site only for lawful purposes.
